Manufacturers and warranty companies
Retailers may occasionally state that the buyer should contact another party, for example, the manufacturer of the goods or the warranty company, to obtain her/his redress. However, in consumer law, if there is a breach of the contract, it is the seller who is strictly liable to the buyer. Only a manufacturer who is also acting as a direct seller will have any obligations under the contract of sale.
A client may wish to contact the manufacturer if, for example, it has provided a guarantee which includes a provision which would resolve her/his consumer problem, as the client can take action for breach of contract if the provisions of her/his guarantee are not fulfilled. The client may also want to consider contacting a warranty company, if the circumstances in her/his case mean that s/he will get a more satisfactory outcome by this means.
