    I know the temptation is to try and be 'nice' to the retailer and look to other people to blame, but the retailer really is the one that has to sort this out to your satisfaction and then they will have to look to their contractual partners to see what they can recover.

    It wasn't clear from your original post but should we assume the battery packs are damaged as a result of the fire?

    Also, was anything else damaged during the incident?

      I'd be very surprised if any retailer of Align kits was not aware of the Castle Creations issue. Is this a shop that sells a lot of heli stuff, or do they just have the odd kit in stock because if they are a 'proper' heli retailer I'm amazed that they wouldn't have known about the recall.

            The ice2 is the one they just sent me. My local dealer does sell a fair few of these but more 450 size.

              My Align dealer will foot the bill for the batterys, but why should he. Its not fare that the small companys have to foot the bill for the big dogs. If the shop has not been told about the recall why should he no about it.
              I have had a gut fall of big companys shafting the little people like me and small companys trying to make living. {sorry about the rant but got done over by a big car company a few months back and cost me 6 grand.}

                Firstly, don't assume that he will end up footing the bill for this, it is good for him if you believe he has, but he'll be doing everything he can to make sure that he doesn't get stuck carrying the total cost.

                On the other-hand, if he was informed about the recall and just didn't pay attention or didn't understand what he was told then he really is responsible and should feel lucky that nobody got hurt.

                I really don't have a lot of sympathy though whatever the situation, this was two months after a very widely circulated and commented on service advisory, if you are going to be a retailer in this business you need to pay at least some attention to what you are selling and what is happening in your market and this was the biggest news for some time.

                  A very sad tale. Certainly the problems with the CC HV range were very well publisied and al suppliers would have been aware I am sure so really down to your supplier to sort out the replacement parts. You were lucky not to have a serious fire on yur hands, theres a lot of energy in the 12S cells!!

                    You are in a very strong legal position. Someone has been negligent. You should have no problems if you point this out. You should certainly get damages. Depends on how much you want to get out of whover is found to be at fault. Lipos are unpredictatble though and there's no guarantee it won't happen again. Once they start to go they keep going. How did you get the battery off without serious burns?

                      Luckly my neighbour ran over to it and just gave the batteries a good tug,not sure how he didnt get burned.

                        I spoke to the shop today regarding the batterys and the chance of me taking legal action unless Align pay for some new ones. Im not after anything else.
                        Just hoping my son will be brave enough to fly it.

                          can you please clarify what esc went up? was it the new ICE2 that went on fire?

                          i assumed it was the original one until you posted above the picture.

                              Its your supplier you need to persue, not Align?!

                              If you arent going to persue your supplier though, you haven't got a leg to stand on.
