  • Advice wanted, sold item problems.

    Hi guys,

    Not having much luck am I!?

    Sold my 500 ESP on the 8th April. Sent it out shortly therafter. Now, when I had it I did have some issues with the power cutting out which turned out to be the red ESC wire was not soldered correctly. I resoldered it and had several flights after and all was well again. I even made a post about it.

    Now, the buyer contacted me on the 17th April saying the power has cut out again and asked me that before he bought a new ESC or battery what did I do. I told him I resoldered the ESC and all was dandy. Heard nothiing back until today where he said following on from Sunday it's still acting up and he wants a full refund and would raise a dis[ute via Paypal if I didn't refund him as good not as advertised etc etc. After mulling over it I said I would not be willing to offer a refund because anything could have happened with it since it's been with him.

    Lastly, he responded to say that he would create a thread here for all to see how dishonest I am etc etc. He also said that he saw my thread and it was clear when he got the heli that I had not resoldered the wire at all. Which begs me to ask, how did he fly it with an unsoldered wire? If he resoldered it himself I fail to see why I should be liable.

    I'm honestly not sure what to do, I mean, if it were me and I had flown and clearly had issues with the heli I would have sent it back from the very beginning but after he's flown it about for a while and potentially binned it I don't see why I should give a full refund.

    Not after a bun fight here, genuinely wanting advice.

      Yes and he paid the fee's.

      As far as I am aware he can raise a dispute and Paypal will investigate.

      He came back to saying that the ESC had never been soldered and that it was as it was from the factory. Even though I soldered and EC3 onto it.

      Very confused as to what has gone on to be honest now.

        I'm guessing that if he gifted it, he can't do anything? How is he going to dispute a gift he gave to you?

          My understanding is when sending as gift the buyer has no comeback.

          Was it sold to someone who is a member here?? Like you say how can he say that the power had cut out again if the wire was never soldered on....

            tell him you dont offer warranty, its a second hand heli for christ sake. your not a shop.

              Hi Dan,

              This is always the risk run buying and selling second hand stuff but ive done it many times so have 90% of us these "issues" will always happen.
              And i understand how you feel.

              In this case i would say that you have not done anything wrong because you told him of the issue with the ESC first and he also read your posting so he paid the money in the full knowledge that there is a problem/potential problem with the ESC. That been the case he should really of said he would have it on agreement that if when it arrived he would inspect it and if not happy return it immediately.
              Keeping it and flying it to me says hes happy with the buy.
              So coming back now demanding a full refund is not really acceptable i understand hes frustrated but it was brought with all cards on the table so to speak.
              Hes obviously not going to let it go so a solution must be reached, i would offer to either split the cost or refund him enough to get a new ESC, as thats all thats wrong?
              Imho i think if it goes to paypal dispute and you make that offer from the outset and explain the facts links to your posts etc etc you have a chance of not been had over by them (paypal not the buyer) Although we know that paypal are a complete nightmare for sellers.
              I wont make comment on his other threats suffice to imply

                Item 1) you want to tell him that if he posts things like that on here he will more than likely be the death for the for sale section, if he did, he would be the most unpopular person on here.
                2) Why not to keep the peace mate, over him the cost of a new esc back, or offer to buy him one, just a idea.

                If he bought it knowing there was an issue and it has re-occured then if he nogociated the price down because of it then no way should he/she get there money back

                  Lynx, let him try. I recieved a busted heli from an ebay seller marked as RTF. I had photo evidence that I showed PayPal and also said I could provide emails from the manufacturer that said there was noway this damage could of been transit damage (eg. feathering shaft on a .30 sized heli was bent like a banana). PayPal ended up awarding it in the sellers favour.

                  What you could ask is for him to send back the ESC and you get him a new one. You can either repair the ESC and use it yourself for your own fleet or get it repaired by the manufacturer and sell it on eBay.

                    Are you sure it was a gift?

                    You pay no fees on gift payments!

                    What end are we talking about having a bad joint onto the circuit board or the battery connector?

                      Looks like he didn't pay by gift, not that it makes any difference. I'm not here to rip ay one off I am just fed up of being treated like a shop! I have asked if he's tried another ESC. Waiting response.

                              With a gift payment the buyer has no comeback and cannot dispute as no fees were paid then the protection is not paid for so not there, on the other hand if he retracts the payment or it bounces you have bugger all come back on him - gifts are not a good way buy and sell unless you know who you are dealing with, I know this as I got stung as a seller.

                              A cut out on a 500 is, well was, a very common thing and could just be a case of static or even a faulty transmitter or receiver, you cant be responsible for them or any user error.

                              As a buyer, you buy used and you take your chances, if you want shiny new and guarantees then buy new.

                              edit, was there a postal address on the PayPal email telling you that you had funds?
