  • anyone good with employment law?

    right basically had a phonecall from one of the engineers at work(i'm on the opposite shift) to ask me to come back out to look at a machine. so i did. The fee we get is £60 + 1 hour at time and a half just for attending plus your time thereafter. The senior shift manager asked the engineer to ring me to come to site so i did this and was there for two and a quarter hours so effectively it would be 60 quid plus three and a quarter hours at time and a half. So this morning i am told i will not be paid anything as the factory manager hadnt authorized the callout so basically im very annoyed at the minute and just wondering what i can do if anything.

        Been there, Got stung.... They lost have lost out on a number of occasions since.

        However, If you have a HR dept, It maybe worth having a chat with them, At the end of the day, you have saved the company a lot of production man hours by going in in good faith and have a strong case (In principle) for being recompensated on this occasion on the unerstanding that in future you will be able to check before going in that it has been authorised.

          Surely the fact is you came into work when asked to, you've worked 2 hrs 15 mins for which you need to be paid for in some way.. It's the senior shift manager who should be in the docks not you... Argue your case!

            clock in and out, also proves you have been there, just say next time unless you have confirmed confirmation you wont come in, they will soon change there mind

              I'd fall back on good old fashioned 'custom & practice' in a case like this.

              Have you previously turned out to similar requests from the same person and been paid?

              Had you previously been made aware that you needed to have authorisation from the Factory Manager?

              Is there a published procedure that covers this sort of incident and if so did you follow it?

                hi tanks for the replies. i didnt think id have a legal leg to stand on but always good to get others opinions and advice. well it had been mentioned but since the factory manager(senior shift manager) had asked the other engineer to ring me i had no inclination to presume that it wasnt a problem to come out. but alas that wasnt the case as the operations manager hadnt personnaly approved it. I have never refused a callout as i know it is a last resort for them and they do genuinely need your help if they ring. Im afraid I am dealing with an a**ehole as i met him on the yard as he was walking to the smoke shed and i was going to factory and all he did was say a sly hello and had the biggest smirk on his face...tosser. its so annoying that when you help a company out they just dump on you for it. But i bet if he had authorized it and i had said no to coming out id still be a tosser for not coming and out. I saved the company from a possible fine from a customer for shorting them on their order or potentially losing business and this is the thanks i get...so annoying.

                  Well if they wont pay you, ask them when they are going to give you the time back in lieu.

                    No way would I let that go without a fight.

                    Do you answer to the 'senior shift manager'? If you do, then you should fight your corner. How are you supposed to know he hadn't been authorised to call you in, are you supposed to be psychic or ask him to post you a signed letter from upper management before you go in?

                      Start sending out the C.V, it sounds like a company that doesn't deserve any loyalty, and if you get the chance to drop that tosser in it do so.

                        Personally I'd go talk to the operations manager about it. Going over the shift managers head with it might knock a few noses out of shape.
                        And unless it's sorted out then next time phone the operations manager before going in, even if it's 4am. It won't happen again after that.

                          Right thanks for all the replies I've had off people. Went in today and common sense has prevailed mad they are paying me but still doesn't take away that sour taste of being stung. Don't worry my cv was dusted off a long time ago.
