legal help/advice..car accident

    can i just say to everyone reading this,if you ever have an accident in your car/on your bike,apart from making sure nobody needs medical attention and getting yourself to safety,the very first thing you should do is take photos of the damage to both vehicles and their position in relation to each other. this will put a stop to all these chancers claiming huge amounts of damage to the cars after a little shunt,and compensation for whiplash etc. there are a lot of scams running at the moment where somebody will purposely go into the back of you at very low speeds,leaving nothing more than a dented panel or bumper,and when they come to claim the insurance their car suddenly has massive damage. a few photos on your phone will save you a massive headache and likely a lot of money too.

    good on your son for leaving his details,most people would just drive off. as said above,the insurance companys deal with things like this every day,im sure they will see this bloke is just trying to make a few quid for nothing. and the sweet thing is,when they find out (which they will) he is trying to pull a fast one,his premium will go up and he will find it harder to get insurance in the future.

        we rang the insurance company yesterday and you guys were right,it's just a matter of forwarding copies of all correspondence to them and they will deal with it.
        they have refused payment to the guy which is why he is now persuing my son privately.the insurance company asked him to take his vehicle to one from a list of repair agents that they deal with in the area,however he chose to use his "local" garage and says the repairs have already being completed,the insurance company have disputed the costs involved and say they are vastly inflated.(he claimed £880 for a hire car for seven days which turned out to be an 51 plate focus supplied by his garage!)
        he is also named on a nation register the insurance companies use as possibly a false claimant in the past.
        It is now in their legal departments hands,I'll keep this thread updated as we learn more.

        Thanks for the earlier advice believe it or not after 37 years of driving ( private and proffesionaly)this is the first time I've ever had anything to do with a claim!

          Thats excellent news Ron. Sounds like the filing the claim is just trying it on. I hope the insurance company do their part and he ends up having to foot the bill in full himself - it will certainly serve him right.
