  • Byley MFC - Planning Permission Application

    Hey guy's,

    We at Byley MFC are about to put in an application for "change of use", after a noise complaint that doesn't stand up by all accounts.

    I have attached the .pdf form as it has been completed so far.

    If anyone wants to have a read and give any advice at this stage it would be appreciated. Also any advice regarding the general processes involved would be gratefully received too

    Not to sure about the waste disposal Tom, it might lead to some regulations. Its probably better to say there is no waste disposal facility (ie members remove any waste they generate, non is left on site)

      Hi Tom, Just read through application..
      I agree with Mark,
      The only thing I would change is
      section 12.
      How will surface water be disposed of?
      you have selected "Soakaway", I would have said "Existing watercourse",
      (Soak-away's are a man made drain, you not doing any work of this type).

      Tom have you been in touch with the BMFA? they have guys there that can help you with planning matters..

      could you keep us all updated on here.

        Hey Tom.

        Was the complaint you received due to model noise? If yes then straight away I'd perhaps say it will be good to have an independant noise tester take readings for you to prove the situation.
        At an old model club we had a noise complaint problem, we took our own readings and capped noise to 80db, but independant testing was more worthwhile. Our case went to the high court reference the BMFA guidelines and herein lies a problem, as they are just guidelines and not set in stone as far as a court is concerned.
        Needless to say after a few years we lost and had to move on.

        How far is your POL (point of launch) from the nearest noise sensative property?

        For us while the BMFA were helpful, they weren't if you know what I mean, but the staff have changed around since then.

          When you apply make sure your known to be a Club non profit organisation Councils will charge you a LOT less when you apply for planning permission.

            Definately agree with wildwake, change water to disposed to natural watercourse

            quick questions.... have you been flying there previously and if yes, for how long?

            have you had any complaints and how long have the complainants been in residence?

              They've been there a couple of years (I think) and as far as I know there was just one complaint fairly recently and probably unfairly. The houses are quite a distance from the field, I'm surprised it bothers anyone.

                Get help from the BMFA before you send this in, don't try to do this on your own.

                Once this is submitted it will be too late to ask for help later on.

                You say on the form that the change of use has not started yet, but you've been there some time and there is a complaint, so that probably needs changing. Also you will need the full name of the land owner.

                  We had been there for 4 years without a single complaint, It turns out that the woman who complained had been having work done to the house and hadn't noticed us there until the work had finished and she was able to use her garden which looking on google earth is a half a mile away from the club. We had actually been round to see her at about the complaint which we thought had been resolved with a few compromises, she was actually quite reasonable about it at the time (well to our faces anyway lol). We could see the helis from her back garde but could barely hear them. Then a couple of months later the farmer recieved a letter from the council saying he didnt have permission for change of use and we should stop flying until it was granted. That was probably 6 months ago now.

                    Ian, thanks, we had a noise complaint yes, she is 850 metres away, we are going to get some independant noise testing done

                    Mark T, thanks, I am currently writing an email to the bmfa to start the ball rolling, I will send them a copy of the application
