Credit card claim for items not delivered?

Has anyone done this before? I had goods on order over £100 from usa, and customs appear to have cocked up and returned it to sender. sender claims they wont refund me or accept any returns. Paid for on my capital one card.

Sender will remain annonymous for now to prevent any flaming, and ive offered him a chance to fix it.

ring your card service, number narmally on the back of your card, told them you have not received it, they will do it for you. cheers andy
