    Howdie,

    I expect any answers to this post will result in varying differences of opinion.

    If an item is advertised on a website does the vendor have to honour the advertised price? Or, can they claim that it was advertised incorrectly and refuse to sell at the advertised price?

        They often say prices subject to change without notice so they are covering themselves. I got a Scorpion motor from fastlad which i paid £75 for but i recieved it with a £72 price tag on it

          I thought that if it is advertised at a price by law they have to sell it at that.

          Its also implied that this is true on a car manufacturers radio advert.

          Im sure someone will take the time too look it up and give us the answer.

            I have had to look into this myself for our company. Basically the answer is, it depends.

            There are a few sensational cases where the likes of Kodak had to honour some online sales where the price was a mistake. But if a price is obviously a mistake and it is clear the customer knows this then they will not have a case.

            It's also dependent on the sellers terms and conditions because although anyone selling in the UK has to adhere to the UK selling and distance selling regs, there are still things that can be defined in the terms and conditions as to when a sale is final etc.

              The item i saw for sale was listed about £20 cheaper than it should be. Looks like they missed out a figure. Other items above and below were priced correctly, so it was pretty obvious to me that they had made a mistake.

              I could have placed an order and then argued the toss with them... But i wouldnt do it as i know it is a mistake.

              If it was a single item on a single page that might be a different matter!

                it has always been my understanding that in any uk shop if a product is price up at one thing then the till says differently then AS LONG AS THE SHOP AGREES TO SELL IT TO YOU you only have to pay the price of that sale ticket......

                how ever i have been in shops where the manager as refused sale then had all the items taken off the shelf for no longer than half hour till the price has been recified but this does nothing for customer/shop relations

                  There are a few few points to keep straight which affect what happens.

                  Invitation to treat
                  Offer
                  Acceptance

                  Products placed on a website are an 'invitation to treat' not an 'offer' and as such are not capable of being 'accepted' so there is no contract until you make an offer by placing them in the cart and providing payment details and the store accepts your offer by taking funds from your card.

                  There is also a 'get out' clause for automatic payment systems that gives an online store a resonable period to notice the error and correct it if their system processes payments without human intervention. This period ends when they ship the goods though.

                  Similar situation in a store, they lay out the goods, you make an offer to buy them and they then decide if they wish to accept your offer.

                  Up to the point where they take your money they can decline to sell to you but once they take the money they can't run after you to try and correct the error.

                  Some exceptions there as well covering situations like a hotel where they only find out later you stole the bathrobe so they add that to your bill after you leave
