  • Great minds think alike! Or maybe not!

    I hate to point this out but it seems RC Heli Resource has stolen the logo of Stainburn Heli club!

      We definitely have had this logo designed in late 2005 early 2006. Here is the earliest usage of it that we could find still on our site and in the internetarchive.com

      While we dont condon trademark infringement we would appreciate it if someone would contact this club and let them know we would appreciate it if they would change their logo because it would be silly of us to take legal action against the very people that we entertain.

      they can contact me at derrickt@rcheliresource.com

      thanks for notifying us of this violation.

        Oh pleeeeeeeeeeeeease, come on.

        If it's on the internet, then it's in the public domain, so it's available to whoever wants to use it.

        If the Stainburn club are using a version of your logo, then they are promoting your brand image, so be thankful.

          Whilst I appreciate your point - I would have taken the view that provided it was done in taste and wasn't damaging your own brand which it doesn't. Then roll with it - rather than fire off its ours keep off or else approach.

              do you have a up to date patent on your logo,as if you were to use the nike tick logo you would be in serious trouble, and i would also think that nike would not just say as long as you use it with taste and its not damaging their brand name then its ok as stuart as written.

                  I agree. It would be silly to take legal action against:
                  * someone in a different country.
                  * in a different market (heli club rather than heli news)
                  * who consume your product.
                  So why even suggest it?

                    Given the completely different colours, slightly different shape, and totally different text I doubt this would stand up as a conflict of trademarks. But for a company to challenge the stainburn club, who probably have no or very little assets and are non-profit making and are not competing in any way, would cost them $$$$$$ and all they could be awarded was the profit stainburn had made from using the logo (nil), and compensation for their loss (nil). I think.

                    If they wanted to be serious I can recommend a US based trade mark lawyer who would love to take loads of money off them.

                      It was probably inappropriate for Derrick to even mention the words legal action. However if Derrick is right then the current situation is damaging for his brand. I for once thought that RC Heli Resource was the one in the wrong. I would like to think this is a case of innocent infringement and whoever is in the wrong will change his logo and move on.

                        Why was it inappropriate for us to say we WOULD NOT seek legal action? It our brand which is "YES" trademarked here in the U.S. I am not sure why it seems that we are being now criticized for thanking people for pointing this out and stating NO LEGAL action would be taken...and that the other party should PLEASE change their logo. The responses to this message just validate the reason why we at RCHeliResource will never have a forum. I guess the best response would have been NONE at all.
