    evening

    i got some bad news over last 2 days, basically i got sacked from my job over a bit of a **** up, i can appeal but when the company is looking to get rid of 180 drivers in south yorkshire it doesnt look good

    Looking on the bright side

    i get to have some spare time to get some practice and flight time with my heli

        sorry to hear that chris, still might be worth appealing or you could go down the unfair dismissal route .

          sorry to hear that.

          I would do everything you can to keep your job, especially in the current climate as finding another job won't be easy.

          Visit the CAB for some proper advice not just what someones mate down the pub did when it happened to him etc etc...

          You can probably get a free 30 mins consultation with an employment solicitor as well if you ring round a few.

                is that deemed gross miscounduct in your role!!?

                Beleive me.... it is very difficult to dismiss individuals unless their actions have been extremely negligent in the first instance.

                Of course i dont know the details of your case in full but i would be surprised if they can "sack" you without going down a disciplinary procedure unless missing these tickets was deemed.... and can be proved as gross misconduct.

                  I was under the impression that it is very hard to actually 'sack' someone in full employment (possibly easier with contractors etc.). As far as I know there has to a disiplinary procedure which involves verbal/written warnings etc and repeat offenses prior to actually being pushed... most seem to go with a settlement to get the person to leave signing an agreement that they wont take it to tribunal. As it was a mistake then I doubt they have grounds for dismissal. Sounds a bit like they are going for a cheap option to redundancy...

                  I am no employment law expert but I am sure my boss mentioned this sort of hassle when we had a person who was worse than useless...

                  certainly the CAB &/or solicitor would be what I would look into.

                    i was in the same sort of situation once - being sacked unfairly.

                    i went straight down the appeal route, at the time i could easily get another job so when they offered some cash i grabbed it and brought a monster truck lol (wasnt into heli's then).

                    at this current time tho getting your job back is probably a bit more important than getting a new heli out of the redundency payment, so fight back and dont stop.

                      Best advice was in post #5, get some proper advice, don't just go through the appeal process blind or you may miss an opportunity.

                      It isn't hard to sack someone if you stick to the rules and they give you enough justifiable reasons to sack them, nor is it hard to sack someone who doesn't get the right advice, but it is expensive if you don't follow the rules and if the person didn't actually do enough things wrong, enough times and they challenge it properly.

                      As mentioned above, a single event can't result in a sacking unless it falls into a very narrow category of events usually referred to as 'gross-misconduct'.

                      Don't assume the appeal process will deliver 'justice' if you are unprepared. Also you need to fight this as best you can as with the job market as it is you don't want to be applying for a job with a 'sacking' as your reason for leaving the last employment.

                        just like to say a big thanks to all who took time to read a give their support on this, ive started to appeal for the job back just a waiting game now, the problem is they have to loose 180 staff throughout south yorkshire on trains and buses, any excuse for them really, Im gonna fight it though.

                            mate im an employer and it is hard to sack someone that has been with you for two years or more.unless this was classed as gross misconduct you should have been suspended on full pay while an investigation is carried out.you will then be called into a meeting in which you are allowed to take someone in with you ie union rep etc.But if you havnt been there long theres not a lot you can do sorry mate.check www.businesslink.gov.uk for emploment law

                              A bus company around here has sacked a driver I know 2 or 3 times recently, after each appeal they reinstated him. I think they are trying to reduce numbers by sacking and hoping of no comeback. It is cheaper than offerieng redundancy.

                              By the way, the reasons he got sacked were worse than yours!! appeal and good luck, you hopefully should be fine
