    I disagree. Neither party needs to prove anything outright as it's not a criminal court. It's down to what's likely.... It's down to both parties to CONVINCE not prove to the judge....

    So I believe anyway....

    But eitherway. It's not really on topic for this thread, I guess, as I have no reason to disbelieve your assertion that they try to get away with a 3 month warranty... But if OS wanted too they could fight you if you had a claim after 2 years of ownership....

    When I read your original post I was just a little flabbergasted!

      rob, as i said the laws are vague which helps no one and normally the onus is on the consumer according to the consumer law pack on DTI site which is below.

      • In general, the onus is on all purchasers to prove the goods did not conform to contract (e.g. was inherently faulty) and should have reasonably lasted until this point in time (i.e. perishable goods do not last for six years).

      • After six months and until the end of the six years, it is for the consumer to prove the lack of conformity.

      No, that is the limit for bringing a court case in England and Wales (five years from the time of discovery in Scotland's case). An item only needs to last as long as it is reasonable to expect it to, taking into account all the factors. An oil filter would usually not last longer than a year but that would not mean it was unsatisfactory.

      this bit is probably the "get out clause"

      that said no one seems to be able to confim aligns stance and thankfully the buyers recourse is with the seller and not the manufacturer within the UK so i'm sure skyline and or robbe would do the right thing.

        Have you ever returned anything to Robbe under warranty? I can't comment on Align UK's customer service but Robbe often take months to sort out warranty returns, I know my local shop replaced a faulty Robbe balancer out of their own pockets rather than making me wait for Robbe to sort it out. I appreciate my contract is actually with the shop I purchase goods from, not the importer but we all know warranty claims always are the ultimate responsibility of the importer.

          no i have never dealt with robbe myself. i've been fortunate with align stuff but i avoid running align electronics after a failure of a 2-1 reg.
